As our products are crafted from natural wood and MDF, wood grain, texture, and finish may vary naturally between individual pieces — this is a characteristic of natural materials and not a defect. Minor natural variations in wood grain and MDF texture are not grounds for return or replacement.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. Eduspark Toys is not liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from use of the service, products, or arising from misuse, unsupervised use, or use contrary to product guidelines.

SECTION 22 – PRODUCT SAFETY & LIABILITY DISCLAIMER

This section specifically addresses product safety and physical use liability. For general service and website liability, please refer to Section 13 (Disclaimer of Warranties; Limitation of Liability). All products sold by Eduspark Toys are designed and intended for educational and recreational use under adult supervision. Our toys are not suitable for unsupervised play.

Eduspark Toys shall not be held liable for any injury, harm, choking hazard, or accident arising from:

  • Misuse or unsupervised use of the product
  • Use by children below the recommended age group specified on the product
  • Failure to follow product instructions or safety guidelines
  • Modification or alteration of the product

It is the sole responsibility of the parent or guardian to ensure that the toy is appropriate for the child's age, size, and developmental stage, and to supervise play at all times.

 

SECTION 23 – PRODUCT WARRANTY

Eduspark Toys warrants that all products are free from manufacturing defects at the time of delivery. Our warranty terms are as follows:

  • *Warranty Period: 7 days from the date of delivery, consistent with our Returns & Exchange Policy*
  • *Coverage: Manufacturing defects, structural defects in wooden products, and paint/finish defects*
  • *Not Covered: Damage due to misuse, rough handling, water/moisture exposure, unsupervised play, normal wear and tear, accidental damage, used/tried products, or products with destroyed packaging*
  • *Claim Process: Contact us within 7 days at Info@edusparktoys.com or +91 93724 75696 with photos of the defect. Products must be returned in original packaging including all manuals, cards, and tags*
  • *Return Shipping: Customer is responsible for return shipping costs. All return shipments must be prepaid — COD packages will be rejected*
  • *Resolution: At our discretion, we will offer a replacement or store credit. No cash refunds under warranty claims*

This warranty does not affect your statutory rights under the Consumer Protection Act, 2019 (India).

All prices displayed on edusparktoys.com are in Indian Rupees (INR) and are inclusive of applicable Goods & Services Tax (GST) as per prevailing rates under Indian tax law.

SECTION 25 – AGE RECOMMENDATIONS & PRODUCT MATERIALS

Product Materials: All Eduspark Toys children's products are made from:

  • *Wood & MDF — responsibly sourced, child-safe materials*
  • *Non-toxic paints & prints — all colours and prints are non-toxic and child-safe*

Age Recommendations:

  • *1–3 Years (Toddlers): Montessori sensory and sorting wooden toys. Adult supervision required at all times*
  • *3–5 Years (Preschool): Pretend play kitchen sets, tool benches, easels and role play toys. Parental guidance recommended*
  • *5–12 Years (School Age): Advanced role play sets including wooden kitchen sets, kids dressing tables & vanity sets, building blocks and doctor sets. Suitable for independent play with periodic supervision*
  • *Adults/Family: Certain products such as the Mahjong Set are intended for adults and family use only and are not suitable for children*

Age recommendations are indicated on product packaging and listings. Parents are solely responsible for ensuring age-appropriateness. Eduspark Toys shall not be liable for any injury arising from use below the recommended age group.

SECTION 26 – EMI, BNPL & THIRD-PARTY LENDING

Eduspark Toys offers EMI and Buy Now Pay Later (BNPL) payment options through third-party lending partners, which may include but are not limited to GoKwik PAY IN PARTS (facilitated by Liana Credit Private Limited), credit card EMI options offered by your bank or card issuer, and other financing providers made available at checkout from time to time.

By choosing any EMI or financing option at checkout, you enter into a separate credit agreement directly with the respective lender or your bank/card issuer and agree to be bound by their terms and conditions.

Eduspark Toys is not responsible for:

  • EMI collection, interest charges, processing fees, or penalties levied by the lender or bank
  • Credit approval or rejection decisions
  • Any disputes between you and the lender or bank regarding your EMI account or repayment
  • Foreclosure charges or pre-payment penalties imposed by the lender

In the event of a return or cancellation of an order placed via EMI or a financing option, the refund will be directed to the respective lender or bank as per the agreement in place. Eduspark Toys shall not be liable for any chargeback or dispute arising from customer misrepresentation or fraud during the financing application process.
